US-based companies sell $40B of software annually, making it one of the top technology export sectors. Most of that software is subject to at least some level of export controls.
If you want to develop your understanding of how the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR) apply specifically to software, this is the webinar for you.
What sort of software is controlled? Do you need an export license? Is there something else your organization must (or should) do before you begin to sell, deploy, or develop software outside the US? This course will help you to answer these important questions, as well as the following:
- How the ITAR approaches controlling software
- All the ways the US Munitions List (USML) captures software, often without mentioning it
- ITAR software exemptions and licensing considerations
- Deemed exports: how you can make an export of software without sending it out of the US
- What software is and is not subject to the EAR
- Treatment of software as a service (SaaS), cloud computing, and open source software
- Software classification on the Commerce Control List: Order of Review, 600 series, typical vs. atypical software ECCNs, and more
- Encryption software: what it is, how it’s controlled by the EAR, and how it’s both unique and ubiquitous
- Major license exceptions which may allow software exports without a specific license
- Considerations for overseas development and testing
This webinar will include PowerPoint slides and live video and commentary from Scott Gearity, who brings nearly 20 years of consulting, training, and corporate export compliance program management experience to bear for his clients. Each registrant, even if unable to attend, will receive a copy of the presentation, certificate of completion, speaker contact information for follow-up questions, and access to the webinar recording within 24 hours after the webinar airs. Webinar participants are invited to submit questions during the webinar and the final 30 minutes will be allotted to answering attendee questions.
